Gifting is love made visible. But when it involves NRIs and cross-border transfers, it also becomes a matter of law and compliance. Whether you’re an NRI gifting money to a family member in India, or a resident Indian transferring assets abroad, there are critical tax and FEMA rules you cannot afford to ignore.
Let’s decode this hot topic—from who qualifies as a “relative,” to exemptions and traps you must avoid.
🎯 What Qualifies as a “Gift” Under Indian Income Tax?
A gift may include:
- 💵 Money: cash, cheque, or transfer
- 📦 Movable assets: shares, jewelry, etc.
- 🏠 Immovable assets: house, land, flat
- If total gifts received in a financial year exceed ₹50,000, they may be taxable in the hands of the recipient, unless falling under the exempt categories.
- 💍 Gifting on the Occasion of Marriage – A Powerful Exemption
- Under Section 56(2)(x) of the Income Tax Act, any gift received by an individual on the occasion of their own marriage is 100% tax-exempt, regardless of the amount or donor.
✅ This exemption:
- Applies even if the giver is not a relative
- Applies only to the bride or groom, not their family members
- Does not apply to anniversaries or engagements—only the wedding itself
- 📝 Pro Tip: Maintain a proper record of gifts received on marriage for future reference in case of inquiry.
