When it comes to managing finances across borders, one of the most common and important questions we receive at VCAREFIRST is:
“Am I considered an NRI for Indian tax purposes?”
The answer might surprise you—because it depends on how many days you spend in India and a few new tax rules you may not have heard of.
✅ Who Qualifies as an NRI Under Indian Tax Law?
Under the Income Tax Act, 1961, your residential status is based on the number of days you stay in India during a financial year (April 1 – March 31).
👉 You are an NRI (Non-Resident Indian) if:
You stay in India for less than 182 days in a financial year,
OR
You stay less than 60 days in the financial year AND less than 365 days in the immediately preceding 4 financial years combined.
👥 Special Relaxation for Indian Citizens and PIOs
If you are an Indian citizen or Person of Indian Origin (PIO) who is:
1) Going abroad for employment, or
Visiting India temporarily,
then the 60-day limit is extended to 182 days, which makes it easier to maintain NRI status.
2) Whose Total Income, other than Income from Foreign Sources, exceeds ₹ 15 lakh during the previous year,
then the 60-day limit is extended to 120 days.
⚠️ New Deemed Resident Rule (Post-Budget 2020)
To close tax loopholes, India introduced a new condition:
💼 Why Does NRI Status Matter?
Status What Income is Taxable in India?
NRI Only income earned in India (e.g. rent, dividends, capital gains)
Resident (RNOR) Indian income + income from a business controlled from India
Resident (ROR) Indian income + income from a business controlled from India + Global income is also taxable in India

📌 Real-World Examples
Ravi is a software engineer in Dubai. He visits India for 150 days. He is still an NRI under the 182-day rule.
Sneha is a consultant working remotely from several countries. She stays 125 days in India and earns ₹18 lakh from Indian clients. She’s now a deemed resident (RNOR).
✅ Final Takeaway
✔️ If you spend less than 182 days in India and meet no other conditions—you’re an NRI
✔️ If you earn ₹15L+ in India and don’t pay tax abroad- you’re deemed resident
✔️ Your residential status determines how your income is taxed
